IMPORTANT NOTICE: PLEASE READ CAREFULLY BEFORE ACCEPTING.
The following terms of use (Terms of Use) is a legal agreement between you (You) and The Royal Bank of Scotland plc (We, Us or Our) for the use of RBS’ prototype REST API and developer portal known as ‘Blue Bank’.
By clicking on the "Confirm" You agree to these Terms of Use which will bind You. If You do not agree to these Terms of Use, We will not make available RBS’ prototype REST API and developer portal known as ‘Blue Bank’.
AGREED TERMS
1. DEFINITIONS
1.1 The expressions which follow are given these meanings unless the context in which they are used requires a different meaning:
- “Service” means the provision of the Materials by Us to You;
- “Materials” means the prototype REST API and developer portal known as ‘Blue Bank’, together with a sandbox, specifications and technical literature; and
- “Project” means the project organised by Us through a series of “Hackathons” involving You and other users to explore the integration between RBS computer systems and third party-provided computer systems and applications.
2. GRANT AND SCOPE
2.1 In consideration of You agreeing to abide by these Terms of Use We grant You a non-exclusive and non-transferable licence to receive the Services and use the Materials.
2.2 You may use the Services and Materials for the sole purpose of participating in the Project. You acknowledge that You will only have access to test data.
2.3 You agree to comply with all third party licence terms and conditions made known to the You by Us.
2.4 Except as expressly set out in these Terms of Use, You agree not to lease, sub-license, loan, translate, merge, adapt, vary or modify the Materials.
3. RESTRICTIONS
3.1 You must:
a) Not use the Services and/or Materials in any unlawful manner, for any unlawful purpose, or in any manner inconsistent with these Terms of Use, or act fraudulently or maliciously, for example, by inserting malicious code, including viruses, or harmful data, into the Materials;
b) not infringe Our intellectual property rights or those of any third party in relation to Your use of the Services and/or Materials;
c) not transmit any material that is defamatory, offensive or otherwise objectionable in relation to Your use of the Services and/or Materials;
d) not use the Services and/or Materials in a way that could damage, disable, overburden, impair or compromise Our systems or security or interfere with other users; and
e) not collect or harvest any information or data from any Materials or Our systems.
4. OWNERSHIP
4.1 You acknowledges that the Materials are either owned by Us or are licensed to Us and You shall not by virtue of receiving the Services and/or the Materials, or participating in the Project, acquire any right, title or interest in and to them.
5. LIMITED WARRANTY
5.1 You acknowledge that the Materials are provided on an "as is" basis and no warranties are given in respect of the Materials performance, functionality or fitness for purpose. In particular, We make no warranty that access or use of the Materials will be uninterrupted or error free.
5.2 We make no warranty that any innovation developed during the Project or otherwise will be included in the specifications of any future published API as developed by Us or that the API made available as part of the Service will match the features of any published API as developed by Us.
6. TERMINATION
6.1 We may terminate these Terms of Use and Your access to all or part of the Services and Materials upon notice to you.
6.2 On termination all rights granted to You under these Terms of Use shall cease and You must immediately cease all activities authorized by these Terms of Use, including your use of any Services and Materials.
7. LIMITATION OF LIABILITY
7.1 Except as expressly stated in clause 7.3, We shall not be liable to You, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, arising under or in connection with these Terms of Use for any of the following: loss of profits or revenue; loss of business opportunity; loss or corruption of data; or any indirect or any consequential loss or damage.
7.2 Our total liability, whether in contract, tort (including negligence) or otherwise and whether in connection with these Terms of Use shall in no circumstances exceed a sum of £100.
7.3 Nothing in these Terms of Use shall operate to limit or exclude any liability for death or personal injury arising from Our negligence; loss caused by fraud; and any other loss which by law cannot be excluded or limited.
8. GENERAL
8.1 If We have to contact You or give You notice in writing, We will do so by e-mail or by pre-paid post to the address You provide to us.
8.2 Each of the conditions of these Terms of Use operate separately. If any court or competent authority decides that any of them are unlawful or unenforceable, the remaining conditions will remain in full force and effect.
8.3 These Terms of Use contains all of the terms of the agreement between us relating to the matters covered in these Terms of Use.
8.4 These Terms of Use shall be governed by English law. You agree to the exclusive jurisdiction of the courts of England and Wales.
9. PRIVACY
9.1 For direct communication with you and for authentication purposes, we shall store the following Personal Data about you: First Name, Last Name, Email Address and Mobile Phone Number. We will not use this information for any other purpose.
9.2 We will not share your Personal Data with any other party
9.3 You may view and update your First Name, Last Name and Email Address from the Profile page on our Developer Portal.
9.4 You may view, update and remove your registered Mobile Phone Number by making a 'PATCH /customer' API call
